What happens to children in the event of losing both parents?

Do you know what would happen to your children if anything happened to both parents?

Whether you are just starting a family, or have children under eighteen years old, many parents will have done all they can to protect their children. However, making a Will is one factor which often goes overlooked when putting protective measures in place to safeguard children, yet this could have huge implications for your children if you do not have one in place.

If the worst were to happen to both parents, do you know what would happen to your children?

Some people choose to appoint a ‘God parent’ and may be of the understanding that this ‘God parent’ would take custody of their child, or children, on the death of their parent(s). This is a common misconception and has no legal standing. 

Without a Will in place, the Court will establish who will have custody of your child following your death. 

This may result in someone whom you would not choose to look after your child(ren) to be given parental responsibility. This could also take a considerable amount of time to resolve, causing unnecessary trauma for your child(ren) during an already difficult time. 

To avoid this, it is important to include a guardianship provision within your Will as you can appoint official guardians for your children, so should the worst happen to their parent(s) you can name who you would want to take care of your children.

You can also state how the money you leave them is to be used and your wishes for how they are to be brought up in your absence. Including a guardian provision within your Will, means that you can legally pass on parental responsibility to this person(s), upon the death of the child’s parent(s). 

As it stands, anyone with parental responsibility can appoint a guardian for a child. Anyone acting as a guardian also has the power to appoint a further guardian if necessary.
