In recent news articles it has been bought to the public’s attention that the Southern Health and Social Care Trust NHS paid out over £8 million as a result of clinical negligence.

In the report that was released in June it explains that the trust totalled £9.4 million in special payments which covers areas such as “compensation payments in respect of clinical negligence employers’ liability and public liability claims”. Patients, Visitors and Staff are able to claim against a hospital for negligence caused as a result in a breach of duty, failing to provide an acceptable and reasonable level of care to a patient which has resulted in harm, injury or complication.

The hospital trust owes a duty of care to all who work, visit and are admitted there, the duty of care required by the trust is dependent upon the circumstances of the alleged incident.

Visitors and staff could potentially claim for personally injury caused by the negligence of the hospital and exposing them to foreseeable injury.
