Justice can still be obtained against alleged abusers who are no longer in the United Kingdom

The Crown Prosecution Service have confirmed that Mr Shahid Hussain who was prosecuted as part of Operation Stovewood was sentenced to 8 years imprisonment on 24 September 2024. 

Operation Stovewood continues to investigation allegations of abuse in Rotherham between 1997 and 2013 and it is reported that so far 36 people have been convicted as a result of the investigation.  

This conviction specifically caught my attention however because Mr Hussain was charged with indecent assault in July 2018 but then failed to appear at the court hearing. It was discovered that he had left the country. The Crown Prosecution Service then obtained a European Arrest Warrant and Mr Hussain was stopped and arrested in Bulgaria in November 2023 following a collaboration between the Crown Prosecution Service, the National Crime Agency and the Bulgarian authorities. 

Following the UK’s exit from the European Union, the UK is no longer part of the European Arrest Warrant framework but it was replaced by a new protocol. 

In another high profile case, a South African court ruled in August 2024 that a former teacher at Edinburgh Academy and Fettes College in Scotland could be extradited back to the UK. The BBC presenter Nicky Campbell is among the people who have made allegations of abuse against the former teacher.     

It is obviously a concern for a survivor of abuse when an alleged abuser either no longer lives in the UK or as in the case of Mr Hussain absconds to attempt to avoid justice.
